Article 3 of the REALTOR® Code of Ethics: Cooperation

Cooperation isn’t just good practice - it’s a professional obligation. Real estate agents may become REALTORS® - which are held to higher standards (a Code of Ethics and Standards of Practice). REALTORS® are expected to work together to ensure smooth, ethical, and efficient transactions. But what happens when cooperating with another broker could actually harm the client’s interests?

 

That’s where Article 3 of the REALTOR® Code of Ethics comes into play.

 

Article 3 states: "REALTORS® shall cooperate with other brokers except when cooperation is not in the client’s best interest."

 

This article establishes two clear expectations:

 

  1. REALTORS® are expected to cooperate with other brokers.
  2. REALTORS® are not required to cooperate if doing so would hurt their client’s interests.

 

Cooperation Is the Norm

 

Cooperation typically means:

 

        Sharing listing information

        Granting access for showings

        Responding to inquiries in a timely manner

        Being professional and responsive in negotiations

 

This spirit of collaboration is essential for keeping transactions moving smoothly, and for upholding trust across the industry.

 

Example: A brokerage is representing a buyer who wants to view a home listed by another broker. The listing agent responds quickly, sets the showing, and later follows up with feedback. That’s cooperation in action. It helps everyone involved, and reflects well on the profession.

 

 

Best Practices for REALTORS® Under Article 3

 

        Communicate clearly with your client about their goals, concerns, and privacy needs.

 

        Document any decision to limit cooperation, and ensure it reflects your client’s interests, not your own.

 

        Remain professional even when cooperation is limited. Explain the reasoning without disparaging others.

 

 

Bottom Line

 

As with many ethical issues, the key is intent. If the actions of a REALTOR® are genuinely in the best interest of their client, and are not motivated by personal conflict or gain - they're likely standing on solid ethical ground.
